State law sets at least $41.00: $26.50 for the license, indexing, recording and certificate (KRS 64.012(1)(n)), a $10.00 records-storage reimbursement (KRS 64.012(3)(a)) and the $4.50 state tax on each marriage license, collected before it is issued (KRS 142.010(1)(a)). Counties may charge more — Henderson charges $60.00.
Two witnesses — at the ceremony, not at the counter. KRS 402.050(2): “At least two (2) persons, in addition to the parties and the person solemnizing the marriage, shall be present at every marriage.” You do not need them to get the licence; you need them standing there when you marry. The officiant's return to the clerk has to give “the names of at least two (2) of the persons present” ( KRS 402.220 ), so this is checked after the fact, not taken on trust. Read 2026-09-26.
